Civil Rights Manager - (Manager IV): Under the direction of the HHS Civil Rights Office Operations Director or designee, manages and guides civil rights staff in functions such as equal opportunity and equal employment opportunity programs in compliance with applicable laws and regulations including the Civil Rights Act (CRA), the Americans with Disabilities Act (ADA), the Rehabilitation Act, the Age Discrimination in Employment Act (ADEA), Educational Act, etc. The Manager IV is also responsible for implementing programs involving Methods of Administration and other policies and procedures relative to civil rights for the Health and Human Services Commission (HHSC), the Department of State Health Services (DSHS) and the Department of Family and Protective Services (DFPS).
The Civil Rights Manager IV provides ongoing support to civil rights staff including performance assessments, training, coaching, and professional development. The Manager IV is responsible for ensuring accuracy and timeliness of cases under their purview and as assigned. The Manager IV provides guidance and consultation to HHSC, DSHS and DFPS management on civil rights programs, policies, and procedures; ensures compliance with applicable state and federal laws, and agency-specific policies and procedures for HHSC, DSHS, and DFPS programs; and performs other duties as assigned and required to maintain office operations.
Essential Job Functions:
Attends work on a regular and predictable schedule in accordance with agency leave policy and performs other duties as assigned.
EJF 1. Manages, oversees, and provides leadership to civil rights staff responsible for programs administered by the HHSC Civil Rights Office for HHSC, DSHS, and DFPS (each with separate policies and procedures). Oversees, reviews, and approves all aspects of discrimination complaint investigations and dispute resolution for internal complaints including establishing and developing goals, objectives, priorities, and standards for conducting investigations. Coordinates and confers with regional and senior management in developing responses to discrimination charges filed with the Texas Workforce Commission Civil Rights Division (TWCCRD) or the Equal Employment Opportunity Commission (EEOC). Oversees Employment Discrimination Complaint (EDC) investigations, including case planning, intake interviews, witness interviews, evidence gathering and analysis, and reviews reports of investigations. Oversees Management Initiated Investigations (MII’s), conferring and coordinating with senior management and program on requests from senior and executive management to address issues which may or may not be discrimination but impact the workforce in the designated geographic area.
Responsible for timely completion of Reasonable Accommodation Requests (RAR) from agency staff. Ensures accuracy and appropriateness of the accommodation. Advises regional management and employees on possible accommodations and approves and ensures coordination in implementing the approved accommodation. Oversees and coordinates architectural reviews of HHSC benefit offices to identify compliance with accessibility standards. Reports the results as part of civil rights office compliance reviews. Is accountable for ensuring tasks are accomplished within specific timelines. (35%)
EJF 2. Selects, supervises, coaches, counsels, and develops civil rights staff through performance assessment, review of performance on a regular basis, provides support and recommendations for necessary and appropriate training and developmental opportunities and provides accurate and timely feedback to employees. Manages staff daily activities establishing workloads, work schedules, priorities and monitoring to ensure compliance. Responsible for ensuring staff successfully complete complaint investigation and resolution including, issue identification, complaint bases, theories of discrimination, applicable law/agency-specific policy determination, investigative plans, documentation gathering, witness interviews, collating materials, information/data analysis, report preparation, and evidence-based recommendations/conclusions, as well as mediations and facilitations. Approves and disseminates the final investigative report results outlining the findings regarding discrimination, identifying potential or actual risks, and any appropriate recommendations for management to consider regarding the immediate issue or to mitigate future risks. Ensures staff properly complete RARs through the interactive process with the employee, management, and appropriate medical professionals, safeguarding and protecting sensitive data gathered in determining whether the requester is a qualified individual with a disability, can perform the essential functions of the job with or without a reasonable accommodation, and identifying appropriate and effective reasonable accommodations. (30%)
EJF 3. Advises and consults with HHSC, DSHS, and DFPS agency managers and employees regarding compliance with agency-specific civil rights programs, policies, and procedures. Plans, develops, implements, and evaluates agency-specific civil rights policy adherence and compliance, including dispute resolution, sexual harassment, reasonable accommodations, religious accommodations, and program accessibility, including language, physical, and electronic. (15%)
EJF 4. In collaboration with CRO leadership, may identify needs, requests for, and facilitates and/or monitors delivery of civil rights training provided to employees and managers, including development of ad hoc training in response to specific needs. In collaboration with CRO leadership, plans, develops, delivers and assists with the delivery of CRO staff training to assure compliance with current state and federal civil rights laws, agency specific policies and procedures and Methods of Administration. Evaluates impact, effectiveness, and outcomes and recommend changes or updates as needed to meet changing requirements or staff needs. (10%)
EJF 5. Analyzes and interprets federal and state laws, rules, and regulations pertaining to civil rights and equal access. Provides technical assistance and coordinates, as necessary, with other HHSC, DSHS, and DFPS staff to monitor and evaluate HHSC, DSHS and DFPS efforts and ensure both direct and imbedded processes and procedures for area contractors, program providers, and sub recipients are in compliance with applicable federal and state laws, rules, and regulations. (5%)
EJF 6. Represents the Civil Rights Office to other state agencies and organizations in matters related to civil rights and equal opportunity as directed by and in coordination with the Operations Director. Serves as the Civil Rights Office liaison for organizations, communities, and/or advocacy groups. Completes other duties as assigned (5%)

Initial Screening Criteria:
Graduation from an accredited four-year college or university. Civil rights experience may substitute on a year for year basis for the education requirement.
Experience in applying management principles and practices. Experience in problem solving, mediation, and conflict resolution. Experience investigating complaints or investigative methodologies.
Experience working with federal and state laws relating to employment. Including equal opportunity agencies and civil rights laws such as the Civil Rights Act of 1964, Rehabilitation Act of 1973, Texas Commission on Human Rights Act, Age Discrimination in Employment Act, and the Americans with Disabilities Act.
