Brief Job Description:
This position will serve as a support staff in the Enforcement Department. The Enforcement Department is one of seven departments in the Legal Services Division of the HHS Office of Chief Counsel. The Enforcement Department provides legal support related to HHS sanctions against facilities, programs, and services, including reviewing and drafting notices, correspondence, and guidance documents; interpreting state and federal laws, regulations, and rules; rendering legal advice and counsel to HHS agency personnel; providing legal representation in contested case proceedings, and overseeing enforcement litigation in district courts.
This legal assistant position works in the Enforcement Department in the Legal Services Division. The position performs complex legal assistant work. Works under limited supervision, with moderate latitude for the use of initiative and independent judgment. This position reviews and assigns hearing requests, updates and maintains databases, drafts correspondence, obtains program records supporting the enforcement action, dockets cases for hearing at the State Office of Administrative Hearings and supports attorney hearing preparation. Additionally, the position will assist in large scale projects, business initiatives, conduct research, analyze data for statistical and monthly report purposes, draft legal documents; and assist the attorneys with their case management.
Essential Job Functions (EJFs):
Maintains case management system including managing information including quality checks; maintains statistical records and prepares reports; coordinates assignments with support staff to facilitate priority task completion. (30%)
Maintains, organizes, and assigns new contested cases to attorneys. Assists attorneys in scheduling and prioritizing their caseloads. Maintains attorney hearing calendar through Microsoft Outlook. Organizes case files and prepares chronologies, fact summaries. Works on large scale projects, conducts research and analyzes data for statistical and monthly report purposes, participates in business initiatives, and maintains case files in preparation for court proceedings. Sets up and maintains files that are organized chronologically, numerically and/or by subject matter. (25%) |
Knowledge, Skills and Abilities (KSAs):
- Extensive knowledge and experience with case management systems including Salesforce and E-File
- Extensive experience with organizing and maintaining complex file and record systems, including managing multiple tasks, meeting deadlines, planning and prioritizing work.
- Knowledge of accepted business and legal practices and procedures.
- Proficient use of computers, including Microsoft Word, Adobe Pro, Excel, Access, PowerPoint, SharePoint or other similar applications/software.
- Knowledge of legal terminology, state laws, rules, and regulations (Administrative Procedures Act (APA), Texas Administrative Code.
- Knowledge of research methods and techniques.
- Skill in working with the public.
- Skill in effective verbal and written communication.
- Attention to detail and proofreading.
- Ability to organize and maintain complex file and record systems, including managing multiple tasks, meeting deadlines, planning and prioritizing work.
- Ability to conduct complex research; to draft, prepare, and interpret legal documents; to evaluate and relate findings to cases in question; to conduct investigations; and communicate effectively.
- Ability to establish and maintain effective working relationships.
- Ability to work under minimal supervision.
- Ability to work independently and effectively as a team member to accomplish agency goals.
- Skill in using office equipment, including copiers, facsimile, collating, binding, etc. for the compilation of exhibits/evidence.
- Ability to compile statistics, gather data and present data in various forms for the benefit of program clients, stakeholders and management.
Registrations, Licensure Requirements or Certifications:
A paralegal certificate/degree or a minimum of three years’ experience as a legal assistant.
