Brief Job Description:

Serves as the Environmental Operations Rules Coordinator and performs advanced environmental regulatory duties under the supervision of the Environmental Operations Branch (EOB) Manager. Supervises and coordinates the development of technical environmental rules and regulatory guidelines concerning environmental regulatory programs pertaining to asbestos, lead-based paint, abusable volatile chemicals, hazardous consumer products, hazard communication, youth camps and campus program for minors, public swimming pools, interactive water features and fountains, and lagoons, public health sanitation, and tattoo and body piercing. Develops program rulemaking policies, procedures and work plans, and directs the preparation of new and amended rules to implement legislation. Serves as lead technical expert in coordinating rulemaking activities within the department, with State and Federal agencies, including the U. S. Environment Protection Agency (EPA), and with other key organizations to ensure consistent application of environmental laws and rules. Performs comprehensive technical and quality control reviews of complex and high priority investigation reports conducted under environmental program regulations. Evaluates documented evidence and recommends, prepares, and presents cases for escalated enforcement. Serves as a technical expert in responding to legislative, media, and public questions and concerns regarding state environmental program rules. Reviews and analyzes the impact of proposed legislation. Performs other duties as assigned by the Manager to meet the needs of the Environmental Section and the EOB. Duties also include participating in emergency response training and performing emergency response activities as assigned. Works under minimal direction with considerable latitude for the use of initiative and independent judgment.

(40%) Supervises and coordinates the development and amendment of rules and regulatory guidelines needed to effectively implement statutory requirements for Asbestos, Lead-based Paint, Consumer Product Safety, Worker Right-to-Know, Youth Camps and Campus Program for Minors, Public Swimming Pools and Lagoons, Public Health Sanitation, and Tattoo and Body Piercing programs under the Texas Asbestos Health Protection Act; the Texas Lead-based Paint Abatement Act; the Hazardous Substances Act, the Abusable Volatile Chemicals Act; the Texas Hazard Communication Act; Texas Youth Camp Safety and Health Act; Training and Examination Program for Employees of Campus Programs for Minors on Warning Signs of Sexual Abuse and Child Molestation; Swimming Pools and Bathhouses; Pool Safety; Interactive Water Features and Fountains; Pool Yard Enclosures; Minimum Standards of Sanitation and Health Protection Measures; Abatement of Public Nuisances; Texas Mass Gatherings Act; and Compliance with Safety Standards; and Regulation of Outdoor Music Festivals. Works directly with technical program staff in the EOB and with counterparts in the Inspections Unit, Licensing Branch, and Compliance Section to monitor effectiveness of these environmental regulatory programs and to identify program issues that can be addressed through rule revision. Researches and reviews pertinent federal and state statutes and rules in the development of proposed rules. Coordinates with stakeholders; legal counsel; department staff; HHSC Rules Coordination Office, State and Federal Agencies (particularly the U. S. EPA), and with other key organizations to develop rule language and ensure consistent application of laws and rules. Prepares drafts of proposed new and amended rules to implement legislative directives and reflect the most current and accurate information available for each environmental program. Schedules and leads program staff meetings, advisory committee meetings, task force meetings, and/or public meetings as needed to develop rule language and obtain stakeholder feedback in person or using meeting applications such as Microsoft Teams. Ensures that rules accurately reflect appropriate agency policy and statutory jurisdiction. Utilizes technical writing skills and appropriate research methods in the review and development of rule documents.

(25%) Serves as lead technical expert in coordinating rulemaking activities for environmental regulatory programs within the department. Plans and organizes workload to ensure that scheduled rulemaking is accomplished within established time frames and priorities. Directs the preparation of required documentation necessary for department and Health and Human Services Commission (HHSC) formal proposal and adoption procedures, including proposal and adoption preambles, proposed and final rule text, fiscal notes, responses to comments and other agency tracking documentation. Ensures documentation is prepared accurately using Microsoft Word, Excel and PowerPoint. Coordinates and leads staff review of public comments on assigned technical rules. Coordinates the distribution of new and amended rules and notification of rule revisions to stakeholders and other interested persons. Provides technical assistance and guidance to the public, regulated community, and staff in the intent and application of environmental program rules.

 

(20%) Performs comprehensive technical and quality control reviews of complex and high-priority investigation reports conducted under environmental program regulations to ensure the appropriate application of regulatory standards. Evaluates report content, evidence development (written violations, photos, samples, records), and documentation, utilizing inspection data obtained from the Versa Regulatory System. Interprets inspectional findings, lab results, and product or process risk assessments. Based on review findings, recommends, prepares, and presents cases for escalated enforcement. Composes endorsement summaries using Microsoft Word for referral to the Compliance Unit or Enforcement Review Committee (ERC). Oversees the resolution of cases by providing interpretations of laws and regulations and participating in enforcement settlement conferences. Coordinates follow-up inspections to evaluate compliance with legal orders. May assist in conducting joint inspections during special assignments and escalated enforcement cases. May be called upon as a technical expert witness to provide testimony legal case. Consults with Surveillance and Compliance staff as needed to ensure equitable and consistent regulatory compliance program statewide.

(15%) Serves as a technical expert in responding to legislative, media, and citizen questions and concerns regarding asbestos, lead-based paint, consumer product safety, worker right-to-know program, youth camp and campus program for minors, public swimming pools and lagoons, public health sanitation, and tattoo and body piercing rules. Provides technical consultation and interpretations of state and federal environmental regulations to license holders, department staff, members of the public, and government or private agencies. Provides regulatory interpretations of licensing, training, or notification requirements; determinations of regulated activities; and proper documentation of inspection findings in written documents, photos, samples, and record collection. Conducts training and evaluations of Inspection Unit field staff. Performs public speaking, prepares presentations using Microsoft PowerPoint, and presents classes, seminars, and training material to licensees, department staff, members of the public and other government or private agencies in person or Microsoft Teams. Responds to Legislative and media requests for information, following department policies and procedures. Responds to telephone, email, or fax requests for information regarding environmental regulations.

Initial Screening Criteria:

Graduation from an accredited four-year college or university with course work in physical, health or life sciences, or a related field.

 

Preferred Criteria:

Experience in rule development and coordination.

Experience in the field of environmental or consumer health and safety.

Experience coordinating, overseeing, and/or supervising work activities between teams, groups or units to complete projects.

Experience using Versa Regulatory Database system.
